Terms and Conditions
1. Definitions
In these terms and conditions, the following definitions apply:
1.1 WOPL!: WOPL! Amsterdam B.V., located at Stadionplein 300, 1076 CK Amsterdam, registered with the Chamber of Commerce under number 96704160.
1.2 Visitor: Any natural person who enters WOPL!, regardless of whether this occurs as a paying visitor, guest, participant in an activity or otherwise. If the visitor is a minor, he/she is accompanied by a parent, guardian or other legal representative, who is responsible for complying with these Terms and Conditions on behalf of the minor.
1.3 Activities: All programmes, events, workshops, educational sessions and other forms of leisure activities organised by WOPL!.
1.4 Facilities: All physical and digital amenities of WOPL!, including play equipment, installations, catering, shop, sanitary facilities and digital platforms.
1.5 Agreement: The legal relationship that arises between WOPL! and the visitor upon entering WOPL! or reserving a service.
1.6 Force majeure: any circumstance beyond WOPL!'s control that prevents (timely) opening. This includes, for example, natural disasters, fire, floods, pandemics, war, government measures, strikes, energy or network outages and technical faults.
2. Applicability
2.1 These Terms and Conditions apply to all visits to WOPL!, to all online purchases and reservations via the WOPL! website, as well as to all agreements that visitors enter into with WOPL! regarding the use of facilities, participation in activities, events or other services.
2.2 Deviations from these conditions are only valid if agreed in writing with WOPL!.
2.3 By entering WOPL!, whether as a paying visitor, guest or participant in an activity, an agreement is established between the visitor and WOPL!, to which these Terms and Conditions apply. These conditions also apply to additional services and activities that take place within or outside regular opening hours, such as venue hire, catering, shop visits, educational programmes, events, etc.
2.4 In the event of conflicts between these Terms and Conditions and the Ticket Terms, these Terms and Conditions shall prevail. The Ticket Terms apply additionally to all purchases of admission tickets and multi-visit passes.
3. Access to WOPL! and House Rules
3.1. Visitors are granted access to WOPL! only upon presentation of a valid admission ticket or if they have obtained prior permission from WOPL! for access in connection with an activity, reservation or other service.
3.2. Access to WOPL! must take place via the designated entrance and routes. It is not permitted to go beyond the permitted paths or areas, unless explicit permission has been given for this by a WOPL! staff member.
3.3 WOPL! reserves the right to subject visitors and their luggage to access checks. If cooperation is refused, access may be denied without the right to a refund.
3.4 Visitors are obliged to comply with these Terms and Conditions, the house rules as set out in article 8 and published on the WOPL! website, as well as with the instructions of WOPL! staff.
3.5 In the event of a breach of these Terms and Conditions, the house rules or failure to follow the instructions of staff, WOPL! is entitled to deny access, remove the visitor or terminate the visit prematurely. In these cases, there is no right to a refund of the admission ticket or other costs (see article 6.7.5). Any damage arising from the breach may be recovered from the visitor (see article 4).
3.6 WOPL! reserves the right to (temporarily) close the park or facilities in connection with maintenance, emergencies, force majeure, safety or other operational reasons. In these cases, article 6.5 applies to refunds or the offering of an alternative date; there is no right to any other compensation.
4. Liability and Supervision
4.1 Staying at WOPL! is entirely at the visitor's own risk insofar as this is permitted by law.
4.2 WOPL! is liable for damage resulting from a shortcoming or unlawful act attributable to WOPL!, taking into account the nature of the activities and the applicable safety standards.
If and insofar as WOPL! is liable, this liability is limited to the amount paid out by its liability insurance, increased by the deductible. This limitation does not apply if the damage is the result of intent or deliberate recklessness on the part of WOPL!.
4.3 WOPL! is not liable for:
- Damage caused by third parties, including hired parties or other visitors;
- Damage resulting from failure to follow instructions or breach of house rules;
- Damage to personal property or vehicles;
- Damage resulting from force majeure as referred to in article 1.6.
- indirect damage, consequential damage, lost profits, missed savings or non-material damage, unless there is intent or deliberate recklessness.
4.4 Visitors are liable for all direct and indirect damage they cause by failing to comply with these conditions or through careless behaviour. Parents, supervisors, teachers and group leaders are liable for damage caused by the children or group members they supervise.
4.5. WOPL! does not provide continuous or individual supervision or monitoring of children, unless expressly agreed otherwise. The supervision and daily care of minors rests with the parents or supervisors. Parents and supervisors remain responsible at all times for the behaviour and safety of the minors they supervise, including when using play equipment and facilities.
4.6 Visitors and supervisors indemnify WOPL! against claims from third parties arising from their actions or omissions during the visit.
5. Camera Surveillance and Privacy
5.1 WOPL! uses camera surveillance in common areas for the protection of visitors, staff and property. Camera surveillance takes place on the basis of WOPL!'s legitimate interest and is aimed exclusively at security purposes, incident registration and safeguarding safety within WOPL!. Visitors, including children, do not need to give explicit consent for this. Camera surveillance is limited to common and public areas.
5.2 The camera footage is used exclusively for security purposes and is retained in accordance with the General Data Protection Regulation (GDPR). The retention period is a maximum of 14 days, unless extension is necessary in connection with an incident or at the request of a competent authority.
5.3 WOPL! may take photo and video recordings during the visit for marketing purposes. For recognisable recordings of visitors, and in particular minors, prior consent is requested from the person concerned or their legal representative. Visitors who object to this can make this known upon entry. In that case, WOPL! will not use the material and will delete it in accordance with the requirements set out in the applicable privacy legislation.
5.4 WOPL! processes visitors' personal data only insofar as this is necessary for the performance of the agreement, such as access to WOPL!, reservations, complaint handling and marketing communication (if consent has been given). The processing takes place in accordance with the GDPR.
5.5 If WOPL! uses external parties for the processing of personal data, a data processing agreement will – if legally required – be concluded to safeguard the protection of personal data.

6. Tickets and reservations
6.1 Tickets for admission to WOPL! can only be obtained via the official website or recognised sales channels.
6.2 Each ticket is personal and valid for the chosen date and time slot. Tickets cannot be exchanged or transferred, unless explicitly agreed otherwise.
6.3 Visitors are obliged to show their admission ticket on request to WOPL! staff, including security staff. Without a valid ticket, access will be refused or access may be denied. 6.4 Tickets are final after purchase and cannot be cancelled or refunded, unless explicitly agreed otherwise. Pursuant to article 6:230p sub e of the Dutch Civil Code, the statutory right of withdrawal is excluded for tickets and reservations at WOPL!, as these relate to leisure activities on a specific date and/or time. By purchasing a ticket, the visitor agrees to this exclusion.
6.5 If WOPL! itself cancels an activity or visit moment, or in the event of force majeure, an alternative date will be offered or a refund will be provided.
6.7 The following circumstances do not give rise to any right to a refund or compensation:
6.7.1. Loss, theft, late arrival, leaving WOPL! prematurely or not using a valid ticket;
6.7.2. Partial closure of WOPL! due to maintenance, renovation or set-up of activities; insofar as the nature of the visit is not materially affected by this;
6.7.3. Nuisance or inconvenience caused by other visitors;
6.7.4. Facilities not functioning properly (in the case of temporary or incidental malfunctions);
6.7.5. Denial of access in accordance with article 3.4.
6.7.6 Temporary changes to opening hours due to safety or emergencies (such as evacuations or short-term closures). In the event of force majeure, article 6.5 applies.
6.8 WOPL! may offer multi-visit passes via the website. A multi-visit pass entitles the holder to a predetermined number of visits.
6.9 For each visit with a multi-visit pass, a time slot must be reserved in advance via the website. The use of a multi-visit pass does not guarantee the availability of a specific time slot. For the reservation of a time slot with a multi-visit pass, these Terms and Conditions and the Ticket Terms apply, as they apply to regular tickets.
6.10 Multi-visit passes are personal, non-refundable and cannot be exchanged for money. Unused visits do not give rise to any right to a refund.
7. Health and Hygiene
7.1 Visitors with contagious diseases or symptoms that may endanger the health of others are requested to postpone their visit.
7.2 In the play areas, wearing socks is mandatory and footwear is prohibited, unless otherwise indicated.
7.3 If the health or safety of other visitors is at risk, or if hygiene rules and cleaning instructions are not observed, WOPL! is entitled to take appropriate measures. This may mean that access is refused or that a visitor is asked to leave WOPL!, in accordance with article 3.4.
8. Staying at WOPL! and use of facilities
8.1 Visitors are obliged to comply with the house rules as established by WOPL! and with the instructions of staff. The house rules are published on the website and available at the entrance and form an integral part of these Terms and Conditions. Any breaches will be handled in accordance with article 3.
8.2 It is not permitted to enter WOPL! if the visitor:
a. is (evidently) under the influence of alcohol or drugs;
b. disturbs the order or otherwise creates an unsafe situation;
c. appears bare-chested, in offensive clothing or otherwise in violation of decency or standards of propriety.
8.3 It is prohibited to bring weapons, sharp or dangerous objects, explosives, flammable substances or other hazardous materials into WOPL!. If detected, these objects may be confiscated or handed over to the police.
8.4 Visitors are advised to inform themselves upon entry about the location of emergency exits and escape routes. Lifts may not be used in the event of emergencies.
8.5 Play equipment, materials and installations may only be used for their intended purpose. Improper or careless use is at your own risk (see article 4) and may lead to liability for any damage.
8.6 Children may only enter WOPL! under the supervision of an adult (18+). The accompanying adult remains responsible for the child at all times.
8.7 WOPL! is entitled to temporarily take facilities out of use in connection with maintenance, safety or other operational reasons.
8.8 Photo, video or film recordings made at WOPL! that (partly) relate to the design, presentation, activities or materials of WOPL! may not be used commercially without prior written permission from WOPL!. Violation may lead to legal action.
9. Complaints and questions
9.1 WOPL! strives to make the visit to the play and discovery centre and the activities offered run as smoothly as possible, in accordance with the published offer. WOPL! will inform visitors in good time about any closures, maintenance work or other circumstances that may affect the visit. No rights to compensation can be derived from this.
9.2 Complaints about the services or the visit can be made known via info@wopl.nl.
9.3 Complaints must be submitted to WOPL! as soon as possible, and preferably within 14 days of the visit.
9.4 WOPL! aims to respond substantively within five days.
9.5 Minor inconveniences or temporary limitations in the use of facilities, such as (partial) closure due to maintenance, set-up of activities, or nuisance caused by other visitors, do not give rise to any right to a refund or compensation. Complaints about this can of course be reported, but do not automatically lead to compensation.
9.6 Visitors can submit suggestions to improve the services via email or at the desk.
9.7 Items found within WOPL! are kept by WOPL! for a maximum of three months. Perishable goods and items of low value may be removed immediately. After the retention period expires, all rights of the original owner lapse and WOPL! is entitled to remove the found items or dispose of them otherwise.
10. Applicable law and jurisdiction
10.1 These terms and conditions are governed exclusively by Dutch law.
10.2 Disputes will be submitted to the competent court in Amsterdam, unless mandatory law provides otherwise.
11. Final provision
11.1. WOPL! reserves the right to amend these terms and conditions at any time. The most current version is always available via www.wopl.nl. Changes apply from the moment of publication and apply to all future visits and reservations.
11.2 If a provision of these conditions is wholly or partially null and void or is annulled, the remaining provisions remain fully in force. In that case, WOPL! will replace the relevant provision with a provision that corresponds as closely as possible to the purpose and intent of the original provision.
